All road users owe a duty of reasonable care to other users. Any user who causes property damage and/or personal injury to another through negligence can possibly face a civil claim for damages initiated by the victim.
The claimant bears the burden of proof and needs to make his claim before the limitation period expires, as stipulated by the relevant rules and regulations. Otherwise, the claimant's right to seek compensation will be lost.
Recoverable losses are inclusive of property damage, loss of income, loss of use, pain, suffering and loss of amenities (PSLA), loss of earning, medical expenses, bereavement, funeral expenses and Tonic Foods.
